UK guide · Updated 2 November 2026Is Bitcoin legal in the UK?
Short answer: yes. It is legal to own, buy, sell and hold Bitcoin in the UK. It is not legal tender, so shops do not have to accept it, and most crypto is not covered by the protections you get with a bank.
General information, not legal or financial advice. This page summarises official UK sources, listed at the bottom.
Short answer
- Owning Bitcoin: legal.
- Buying and selling: legal, through firms registered with the FCA or person to person.
- Legal tender: no. The pound is legal tender. Nobody has to accept Bitcoin.
- Protection: most crypto is not covered by the Financial Ombudsman Service or the FSCS (see FCA: Crypto basics (InvestSmart)).
Who regulates it
The Financial Conduct Authority (FCA) regulates crypto firms in the UK in three main ways:
- Registration: firms offering crypto services to UK customers must be registered with the FCA for anti money laundering. You can check on the FCA Financial Services Register.
- Financial promotion rules: since October 2023 crypto adverts to UK consumers must be fair, clear and not misleading, carry risk warnings, and cannot offer "refer a friend" bonuses. See FCA: Cryptoasset firms marketing to UK consumers.
- Cooling off for first timers: the first time you invest with a firm, it must give you a 24 hour cooling off period and check the product is appropriate for you.
The UK plans a fuller crypto regime in the coming years. When it changes, this page will be updated.
Tax
HMRC does not see Bitcoin as money. For most people it is treated like an asset, so Capital Gains Tax can apply when you sell, swap, spend or give it away. Buying and holding is not taxed. Being paid in Bitcoin can mean Income Tax. Read our Bitcoin tax UK guide and GOV.UK: Check if you need to pay tax when you sell cryptoassets.
Mining at home
Mining Bitcoin at home is legal. You pay for the electricity, and HMRC may treat rewards as income, especially if you mine as a business (see the HMRC Cryptoassets Manual). Check your energy contract, tenancy or home insurance if you run noisy, power hungry machines.
What is banned or restricted
- Crypto derivatives (such as futures, options and contracts for difference on crypto) cannot be sold to UK retail customers. This ban has applied since January 2021.
- Unregistered firms cannot legally offer crypto services to UK customers. The FCA Warning List names firms to avoid.
- Crypto ETNs were banned for retail until 8 October 2025. Now they can be sold to retail if listed on a UK recognised exchange (see our ETNs and ISAs explainer).
